These Terms cover booking and using Moon Recording Studio (8155 N 24th Ave, Suite B, Phoenix, AZ 85021) and using our website, moonrecordingstudio.com.
1. Acceptance of Terms
By booking a session at Moon Recording Studio (formerly Joey's Room) or by accessing and using moonrecordingstudio.com (the "Site"), you agree to be bound by these Terms and Conditions. If you do not agree to these Terms, you must not book a session or use the Site.
2. Changes to Terms
We reserve the right, in our sole discretion, to make changes or modifications to these Terms at any time and for any reason. We will alert you about any changes by updating the "Last updated" date at the top of these Terms.
3. User Representations
You represent and warrant that you are at least 18 years old or that you are the parent or guardian of a minor who is booking a session or using the Site and agree to these Terms.
4. Booking and Payment
Sessions are booked through our online scheduler, or by calling or texting us. Studio sessions have a two-hour minimum. A deposit of 50% of your total price is due when you book. You have the option to pay in full online or pay the rest when you arrive. You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Site. All payments shall be in USD. All sales are final unless otherwise stated in our separate Refund Policy.
5. Cancellations, Rescheduling and No-Shows
Cancellations, rescheduling and no-shows are covered by our Refund Policy, which forms part of these Terms.
6. Arriving and Session Time
Your session starts and ends at the times you booked. If you arrive late, the time you miss is not added back or refunded. If you are 45 minutes or more late and have not called or texted us, your booking is treated as a no-show.
7. Guests
You can bring up to three guests at no charge. Extra guests are a paid add-on that you select when you book, and the room is capped at seven guests. You are responsible for your guests while they are in the studio.
8. Damage to the Studio
You are responsible for any damage to the studio, its equipment or its furnishings caused by you or your guests, beyond normal wear and tear, and you agree to pay the reasonable cost of repair or replacement.
9. Your Recordings and Files
Once your session is paid in full, the recordings you make at the studio belong to you. We keep your session files for 30 days after your session and may delete them after that, so ask us for your files within that time.
10. User Registration and Account Security
You do not need an account to book. If you create an account on the Site, you agree to keep your password confidential and will be responsible for all use of your account and password.
11. Intellectual Property Rights
Unless otherwise indicated, the Site and all content, including source code, databases, functionality, software, website designs, audio, video, text, photographs, and graphics, are owned or controlled by us and are protected by copyright and trademark laws. This section is about the Site's own content; your recordings are covered in section 9.
12. Prohibited Activities
You may not access or use the Site for any purpose other than that for which we make the Site available. Prohibited activities include, but are not limited to: uploading or transmitting viruses, spamming, or collecting user information without permission.
13. Disclaimer of Warranties
The Site is provided on an AS-IS and AS-AVAILABLE basis. We disclaim all warranties, express or implied, in connection with the Site and your use thereof.
14. Limitation of Liability
In no event will we or our directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages arising from your use of the Site.
15. Governing Law
These Terms shall be governed by and defined in accordance with Arizona law, without regard to its conflict of law principles.
